The Ministry of Public Administration, Digital Society and Media has prepared draft amendments to the Electronic Document Law, which equate such a document with one paper in terms of validity, evidentiary value and written form.
Today, the Ministry organized initial consultations during the development phase of the Montenegro Digital Transformation Strategy 2022-2026, Montenegro Cybersecurity Strategy 2022-2026. And consultations during the general debate on draft amendments to the Electronic Document Law.
The head of the Standardization and Standards Directorate, Jelena Knejevic, said that the bill to amend the Electronic Documentation Law was drafted after many years of implementation of the law.
“In practice, it was found to be necessary to improve it, which primarily refers to the application, legal validity of electronic documents, expressions, etc., and it is necessary to amend it in terms of digitizing paper documents, issuing certificates of digital documents and submitting electronic documents.” It is Knezevic.
She said that developments were proposed in the field of regulating the use and validity of a digital document that had been converted from paper form to electronic form.
According to Knežević, this law equates the electronic document with the paper document in terms of validity, evidentiary value, and written form.
“The electronic form, certified by the issuer of the law, the notary or any other authorized person, will have the same probative power as the original paper document,” Knezevic said.
She emphasized that modernity is the regulation of the method of presenting the electronic document for legal and natural persons to the competent authorities, between the competent authorities and the parties, as well as submitting the electronic document between the competent authorities.
The adoption of this law, as mentioned by Kenzevic, will contribute to improving the business environment, developing e-government services, as well as more efficient procedures for legal and natural persons and competent bodies, which will serve the largest citizens and the economy.
“The use of electronic documents in legal, administrative, court and other procedures will lead to the development of new electronic services with a high level of sophistication,” Knezevic concluded.
She said that saving time and money was calculated, roughly, through the electronic document management system – eDMS for 17 institutions on an annual basis of 60.7 thousand euros.
The Minister of State in the Ministry, Marina Panovic, said that the initial consultations on two strategic documents and the draft law on amendments to the electronic document law are of vital importance to the digitization of the Montenegrin society.
“In the past, we had the opportunity to meet and speak and these conversations showed that these projects are of particular interest to the business community in Montenegro. This is not surprising, given that this set of documents is a very important link in the digital sphere,” Panovic said.
The head of the E-Government Directorate, Mirjana Izetbegovic, said the digital transformation strategy 2022-2026. It represents one of the main strategic documents of the government.
She said that many strategic documents are being formulated in the field of public administration reform and cybersecurity, and the goal is to synchronize these processes.
“It is very important at this initial stage of the consultations that we receive input from economics in the field of e-business, but also from all interested parties,” said Izetbegovic.
She said that the situation analysis will clarify all the problems and challenges when it comes to digital transformation, and that while developing strategies, it will look at the practices of countries that are pioneers in developing e-services, such as Estonia, Slovenia, the United States and the United Kingdom.
The Head of the Information and Communication Infrastructure and Information Security Department, Dushan Krkutich, presented the action plan for developing the Cybersecurity Strategy for Montenegro 2022-2026, along with the action plan for 2022.
He said that the implementation of this document will ensure the improvement of cyberspace at all levels in the country, and the improvement of the institutional framework to respond to increasingly complex cyber incidents.
According to him, improved standards and guidelines adopted by the European Union (EU) and NATO, as well as adequate protection for important information services, will be provided.
“The realization of the action plan will ensure timeliness of action, the transparency of the strategic planning process, and the involvement of all interested national and international actors,” Krkotic concluded.
As announced, the representatives of the economy said that they were satisfied with the drafting of the strategic document and submitted concrete proposals to improve the drafting process, as well as the documents.
“They have fully supported the ministry in defining the strategic and standard framework for implementing digital transformation,” the statement said.
A public invitation to consult with an interested audience was posted on April 19 and will run until May 17.
